Vismaya dowry case Kerala State
As the Kollam Additional Sessions Court is set to rule on Vismaya’s dowry case on Monday, an audio clip was released in which she was heard saying to her father, “I am afraid she will be beaten.”
Vismaya, an Ayurvedic medicine student, was found dead on June 21, 2021 at her husband Kirankumar’s house.
In the clip, a woman who is reported to be amazed is heard saying that if she leaves him there, she may do something. He is heard saying, “I want to come back” and “I can not stand there anymore”.
After Vismaya’s death, the family had alleged that her husband Kiran Kumar was harassing her in the name of dowry. He was an officer in the Department of Motor Vehicles. He was dismissed from the service following a departmental inquiry.
He was arrested after her death and is currently out on bail.
Kiran kumar has been charged under sections 304 (culpable homicide not equivalent to murder), 498A (husband or relative of the husband who abused the woman), 306 (abetment of suicide), 323 (voluntary injury) and 506 (1). (Criminal intimidation) and Sections 3 and 4 of the Dowry Prohibition Act of the Indian Penal Code.
According to the prosecution, Vismaya’s husband had been harassing her in the name of dowry since the ninth day of marriage. Prosecutor Mohan Raj said they had evidence of torture in the form of WhatsApp messages and pictures sent to Vismaya’s relatives a day before his death. 42 witnesses were examined.
Her father had told a TV channel that at the time of his marriage in 2020, Kumar had been given 100 sovereigns of gold (equivalent to 8 grams per sovereign), more than an acre of land and a car worth Rs 10 lakh as dowry.
But Kumar did not like the car and demanded Rs 10 lakh in cash. His father had said that he used to torture him when he said no.
Defendant argued that he was in a state of astonished depression. They also argued that audio clips could not be accepted as evidence.
